Introduction:

These terms and conditions (the "Agreement") govern the use of the Rental Marketing System (the "Service") provided by Mantis Solutions. By using the service, you agree to be bound by the terms and conditions of this Agreement. System users who use the Site must accept and adhere to the Terms and Conditions.

Use of Service:

The Service is designed to assist property owners and agents in marketing their rental properties. You may use the Service only for lawful purposes and in accordance with this Agreement. You agree not to use the Service:

• To violate any local, state, national, or international law or regulation.
• To send, upload, or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of solicitation.
• To send, upload, or otherwise transmit any material that contains viruses, trojan horses, worms, time bombs, or any other harmful or deleterious programs.
• To interfere with or disrupt the Service or servers or networks connected to the Service.

Payment:

Mantis Solutions reserves the right to charge fees for the use of the Service. If Mantis Solutions decides to charge fees, it will provide you with notice and an opportunity to terminate the Service. All fees are non-refundable.

Termination:

Either party may terminate this Agreement at any time with written notice to the other party. Upon termination, you will no longer have access to the Service.

Warranty Disclaimer:

The Service is provided on an "as is" and "as available" basis. Mantis Solutions makes no representations or warranties of any kind, express or implied, as to the operation of the Service or the information, content, materials, or products included on the Service. You expressly agree that your use of the Service is at your sole risk.

Limitation of Liability:

Mantis Solutions shall not be liable for any direct, indirect, incidental, special, or consequential damages, resulting from the use or the inability to use the Service, or for the cost of procurement of substitute goods and services, or resulting from any goods or services purchased or obtained or messages received or transactions entered into through the Service, or resulting from unauthorized access to or alteration of your transmissions or data, or other information that is sent or received, or for other damages.

Indemnification:

You agree to indemnify, defend, and hold harmless Mantis Solutions, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of your use of the Service, or your violation of this Agreement.

Modifications:

Mantis Solutions reserves the right, at its sole discretion, to modify or replace this Agreement at any time. If a revision is material, Mantis Solutions will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at Mantis Solutions' sole discretion.

Governing Law:

This Agreement shall be governed by and construed in accordance with the laws of Kenya.

This Agreement constitutes the entire agreement between you and Mantis Solutions with respect to the use of the Service. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
